He is going to remain in office long enough so that by Minnesota law the special election to replace him won't be held until November 2019, which for this year would be the end of May. That way the Governor's temporary replacement pick will have almost two years in office before a special election to serve out Franken's seat until 2020.
If he resigns now, the statute requires a special election in November 2018.
