Virginia court tosses out one-vote victory that briefly ended GOP majority in House

A three- judge panel declined to certify the recount of a key House race today, saying that a questionable ballot should be counted in favor of the Republican and tying a race that Democrats had thought they had won by a single vote.

“The court declares there is no winner in this election,” said Circuit Court Judge Bryant L. Sugg, after the judges deliberated for more than two hours.

The court’s decision leaves the race for the 94th District tied at 11,608 votes for each Del. David Yancey, the Republican incumbent, and Shelly Simonds, his Democratic challenger.

And it leaves the balance of power in the state legislature at 49-51, in favor of Republicans - at least for now.

In the case of a tie in a House race, state law says the winner is chosen by lot – essentially, a coin toss, according to Virginia state law.

One vote win makes absolutely no sense

I hate making accusations that are unprovable, but what the razor thin victories may signify is voter fraud.

The party that senses defeat guesses the size of the deficit. Then they know how many votes to steal. Since stealing votes is risky -- one can get caught, they try not to overdo it. Hence the close vote tallies.

Poker hands and cutting the deck are not uncommon in small New Mexico elections that tie. I think I’ve seen about a dozen over the years. Life goes on.

I agree with you absolutely...

I wrote earlier...that the odds of a tie were astronomical...implying "cheating".

And especially interesting that it came down to a "defective" ballot....a "chad"....by any other name.

The standard for election ballots is whether the clear intent of the voter can be determined. For instance if the instructions say to p,ace an “X” in the box and one puts a “check” in the box, the instructions were not followed exactly but the intent is clear therefore the vote is valid and counted.

When I was a kid, a jewelry store in a local mall on Long Island, NY had a section which sold coins to collectors.

They had for sale an error coin....a Jefferson nickel which had Jefferson’s head on BOTH sides.

If I were that Republican, I would examine that coin before the toss.

I believe that if all 100 house of delegates seats were decided by drawing lots, the democrats would win 75 of them.
