The Democratic candidate for the 2nd Congressional District in 2016 was indicted Wednesday on charges she lied to the state about feeding needy children.
Businesswoman Shaun Brown, who has already announced plans to seek her partys nomination next year for the same seat, faces two counts of wire fraud and one count of theft of government property.
The federal indictment alleges the fraud is in excess of $439,000.
Brown, 58, referred questions to her attorney, who said she plans to plead not guilty and defend against the allegations.
Shauns goal is that every child is fed, attorney Jimmy Ellenson said. Thats what she keeps saying and thats what she wanted me to say.
In court documents filed in a separate civil matter, Brown decried the underlying federal investigation which has been pending since at least July 2013 as racially and politically motivated.
No hearings are scheduled or attorney listed in the case.
The charges stem from a nonprofit Brown helped found in 1995 with her mother, Jenever Brown, who is not named in the indictment.
According to court documents, Brown handled the day-to-day operations of Jobs Virginia Community Development Corporation, which served as a local sponsor and site coordinator in 2011 and 2012 for the U.S. Department of Agricultures Summer Food Service Program. The program, which has been administered locally by the Virginia Department of Health since 2011, provides meals to low-income children over the summer when they cant get free food at school.
The indictment accuses Brown of defrauding the program from at least April 2012 through December 2012 by inflating the number of meals the charity served.
Brown and unspecified others directed employees to sign blank meal count sheets so they could fill in false, larger numbers at a later date, the indictment said.
In turn, Brown and the others used the fraudulently obtained moneys for their own personal purposes, the indictment said.
The indictment references two specific fraudulent reimbursements: One on Oct. 12, 2012, for $414,671.00 and one on Nov. 15, 2012, for $24,400.
Two weeks ago, Brown and her mother filed a lawsuit in U.S. District Court in Alexandria against the USDA, the Virginia Department of Health and several government employees.
The lawsuit, which seeks $10 million in damages, argued the government discriminated against the charity due to the race and political beliefs of the two founders. It used phrases like racial profiling and hate crimes.
The suit was filed without the assistance of an attorney. The two women asked the court last week to appoint an attorney to help them with their case, but a judge denied the request.
Rep. Scott Taylor, a Republican, defeated Brown last year with 61 percent of the vote to take the seat of Rep. Scott Rigell, a Republican who had decided not to run again.
In a July interview, Brown, who was a delegate for Vermont Sen. Bernie Sanders at the 2016 Democratic National Convention, said she would run for the seat again because she had concerns about the policies of President Donald Trump and the Republican majority.
Before moving to Virginia Beach, Brown lived in Hampton and Newport News, where she ran unsuccessfully three times for City Council and once for the General Assembly.

Im wondering why the Obama DOJ sat on this case ? Hmm Brown was a Bernie bot. Perhaps the charges were to show her what happens when you buck the trend, ( Queen Hillarys Coronation ). Good to see the DOJ doing something after all this time.
