Does it mean cats will be outlawed?
The Migratory Bird Treaty Act has already been so interpreted.
I have a client whose home is near where a flock of migratory birds covered by the treaty decided to nest. He got a letter from the State Department of Land and Natural Resources saying that if his cat disturbed any of the nesting birds or their offspring, he would be liable for violating of the MBTA.
He basically said “screw you,” and as of yet the State hasn’t had the guts to do anything further, although I think his cat does run the risk of being trapped and destroyed.
Mind you, these birds aren’t endangered or anything else (frankly, they are a nuisance), but they are covered by the Treaty and so they are protected.
