How is it accidental if one knows one’s actions will most likely kill birds?

Driving your car down the highway will likely kill a bird or two every dozen years or so, give or take. That's a foreseeable consequence of driving. Would you say the death of those birds is accidental?

A State Trooper ticketed my Dad for taking a hen pheasant when the bird flew into the side of his car. The Old Man showed up in court to fight it and the Judge ripped Smokey a new one before dismissing the charge. This was back in the Sixties though.
