I'm not a fan of Manafort, but this kind of legal process is a good thing. It will be an avenue to get information out into the open that would otherwise remain hidden by the mainstream media.

See what I suggested in Post #89 on this thread:

This lawsuit by Manafort would fit perfectly in the "shadow DOJ" I proposed as a better idea than a special counsel to investigate the DOJ and FBI.

The funny thing is that Sessions and Rosenstein recused themselves from the Trump-Russia B.S. -- which probably means they can now be called as witnesses by Manafort. LOL.

Combine this with the article out today about the composition of the Grand Jury, being filled with BLM and Occupy Wall St types, and he just might pull it off. When that happens, the cabal could be exposed. Interesting to see if they’ll let that happen.

The Mueller probe is illegal BECAUSE it is unconstitutional. I see nowhere in the Constitution the power to create a “special investigator”, especially
with no probable cause to investigate.

I hope he ties Mueller in judicial knots.

The problem is - Mueller and Fed.gov have unlimited money, time and staff. They can, and will, bankrupt literally anyone. Its a peculiar form of extra-legal punishment and tyranny we have here in the USA.

That’s a pretty good argument I think. Except the only question is whether it should be Mueller or some other prosecutor.

It would have to be a pretty creative lawsuit. It will be fascinating to see the actual argument.

The Special Counsel mandate is not in law, but comes from internal DOJ rules as decided by Rod Rosenstein. If Manafort violated the law, he can be prosecuted by the DOJ as the DOJ wishes. The DOJ frequently has task forces that operate similarly to the SC. I doubt the courts are going to jeopardize either.

I have posted before on FR that there is a serious question as to whether the appointment of Mueller as Special Counsel is legally valid in light of the fact that statutory law requires every US Attorney to be confirmed by Congress, and yet DOJ regulations purport to give a special counsel the powers of a US Attorney without being confirmed by the Senate.

Manafort should have standing to raise this objection, since he has been indicted by a grand jury convened by the Special Counsel.

They could have appointed an already sitting US Attorney instead of Mueller as Special Counsel and avoided this legal problem. But they wanted Comey's mentor and best buddy to make sure it went down as desired.

The Manafort case may be particularly relevant to this issue in that one could argue that because a Special Counsel has a limited, defined scope he is not a full US Attorney requiring Senate confirmation; however, in this case the Special Counsel is investigating and obtaining indictments outside the defined scope of Russian collusion during the election.
