Community upset after HOA tells them to leave garage doors open or face $200 fine

AUBURN, Calif. (WCMH) – Members of a California community are upset after their homeowners’ association told them they need to keep their garage doors open during the day.

A list left with homeowners in the Auburn Greens subdivision is giving many residents a cause for concern. It mandates leaving garage doors up from 8 a.m. through 4 p.m. Monday through Friday, KTXL reported.

Residents who fail to keep their garage door up face a $200 fine and an administrative hearing.

“I have nothing to hide. I understand that somebody had someone living in the garage. I don’t,” said Shelly Ia. “I am following the rules. All I am asking is a reasonable way of going around this. If you want to do a monthly, bi-monthly inspection of my garage, I have nothing to hide. If I have something stored in there and you don’t like it, I’ll remove it.”

Perhaps a privileged class member they didn’t want to intimidate.

Problem starts with state statutes. Florida at least.

In order to subdivide a larger parcel in a rural area a landowner needs to build, file and get approved a development plan that MUST have a homeowner association and fees. It is a curse on all future use of the land.

I personally see a 40 acres parcel, with many 10 acre adjacent parcels in the same development. The restrictions say one home per parcel. So the 40 acres cannot be split or even have a second house on it. Owner cannot sell without big loss. And yet the county taxes you as if the land was developable.

I have never heard of a neighborhood “going HOA” against anyone’s wishes — unless there is an obscure item in your property title that says it could happen in the future.

Thanks, just trying to understand.... I’d never live in an HOA.

So EVERYONE in the neighborhood has to agree. Doesn’t look like that would happen unless it’s a NEW neighborhood, or an already deeply communist one.

If I lived in an HOA and they required me to keep my garage door open all day, I'd burn my house to the ground and make sure the fire started in the garage during daylight hours.

In fact, if any homeowner in the HOA wants to put a stop to this, they should notify their insurance carrier of this stupid rule. The insurance company would probably get on the HOA's ass over this.

Usually an HOA is established at the time the neighborhood is developed.

I've heard of rare circumstances where homes in a rural area have provisions in their deeds where they automatically become part of an adjoining HOA if/when the HOA extends a paved road and water/sewer utilities to the adjoining rural area.

Never, never, never buy a home in an HOA community.

Absolutely agree. Problem is, in many areas, if you want a new house, you have no choice but to get an HOA as well. I do not understand how someone can refuse to sell to you unless you are willing to abrogate your rights by signing over authority to an HOA.

I would buy a bunch of manikins and stage shows every day.

Remember, you can play by the rules and still be an a hole.

Cousin had a house in an HOA. Replaced his door. Got served a notice demanding he buy an “approved” door from someone on the HOA’s brother.

My cousin had all kinds of fun with that. Enough that everyone else on his street started buying non approved doors.
