I’m sorry, this is the first I’m hearing that there are not 3 co-equal branches?

I see too all of your options Congress could choose to use are in frequent play and on the table for consideration.

Were I a justice, I could happily forego the commute and work from my home office. Jammies-time.

They cannot compel the Chief Justice to appear. They can invite him. They can subpoena the FISA applications. They WILL NOT do what you suggest.

IMO the recent series of memos and text messages is a well-orchestrated plan to achieve many things. One of them is to see who will crack first, the FISA judge (or judges) who approved the warrant and its renewals, or the people in the FBI who asked for warrant/renewals.

I believe that the whole warrant and approval process was “cleverly” crafted to give all involved plausible deniability in the event it ever came to light. But now it has and the deniability is looking mighty thin.

So the judge has a choice. He can either claim to be completely in the dark and innocent or he can say that he knew. If he claims innocence, then he is (if I understand correctly) essentially forced to haul the person(s) who applied for the warrant back into his court and charge them with various types of fraud or whatever. He hasn’t done that, so it seems to me that by doing nothing, he is tacitly admitting he was a party to the fraud.

How could it be otherwise?

Simon, my sense of it is that Roberts would be invited
to answer generic questions about the operation of the
FISA court. It would not be a waste of time if the
legislature and the public could find out how the FISA
court is supposed to work and what happens when the
court learns that they have been scammed.

But, two things come to mind. First, I don’t think
Roberts has the balls to answer questions that might
initiate a shit storm which will wash away so many
Dimocraps . Second, my evolving conspiratorial
side is causing me to think that maybe the FISA
court might have already been compromised (see my tag).

Then subpoena him. Just because he sits on the scotus doesn't mean he's above the law or above a congresional subpoena.

It would be like either the potus or congress ignoring a court ruling.

Not only co-equal, but co-accountable to the others as well.

I wouldn't expect Roberts to testify to anything ever, forever, with all the jeopardy he has had over the years. Roberts has been compromised forever.

Roberts is why we got obmacare in case anyone forgot.We got o/care because of a last minute change of heart by Roberts who decided that zero care was really a tax. That was after he had already written "the against" on zero care since it was the worst form of law to come along ever in US history and even Roberts could spot it. Once he changed his mind he was dogged in his decision. Even Justice Scalia who tried for a solid month to change his mind was unsuccessful. Now what motivated such a change? His life,his family,most likely one of the two or both.

IMHO,Roberts motivation to switch in support of zerocare was never anything to do with his alleged homo past. I don't see that as being relevant even if it was true.

Roberts smuggled in his two kids first from Cork County Ireland to Central America and then here.

He got away with it for years even thought the NYTimes discovered as much but refused to print it years ago.During a normal bio that the times did on any high ranking govt. type the times came to his kids and discovered where they really came from. The story ended there. They never pursued it any further claiming it would have violated the children's civil rights. Something scared them off for sure.

When it came time to decide zerocare Roberts' sudden change of heart was most likely motivated by dnc investigators who figured out what he did. They had to be desperately looking for something,anything, that would sway his vote.

Were they helped along by the NYT? Inquring minds.....
