Unfortunately, it isn't really a matter of being charged with a crime. This probably has more to do with passing a BI. If he didn't disclose anything yet multiple people interviewed accuse him of aberrant and/or violent behavior then you will not pass the BI.

I would assume that the job he has required a clean BI. It's not really a fair process and it isn't meant to be but remember that unfortunately the long knives are out for Trump and anyone associated with this administration. Also remember it's the FBI conducting these investigations.
