Byron York: Comey told Congress FBI agents didn't think Michael Flynn lied

In March 2017, then-FBI Director James Comey briefed a number of Capitol Hill lawmakers on the Trump-Russia investigation. One topic of intense interest was the case of Michael Flynn, the Trump White House national security adviser who resigned under pressure on February 13 after just 24 days in the job.

...Lawmakers wanted Comey to tell them what was up. And what they heard from the director did not match what they were hearing in the media.

According to two sources familiar with the meetings, Comey told lawmakers that the FBI agents who interviewed Flynn did not believe that Flynn had lied to them, or that any inaccuracies in his answers were intentional. As a result, some of those in attendance came away with the impression that Flynn would not be charged with a crime pertaining to the January 24 interview.

Nine months later, with Comey gone and special counsel Robert Mueller in charge of the Trump-Russia investigation, Flynn pleaded guilty to one count of making false statements to the FBI in that January 24 questioning.

What happened? With Flynn awaiting sentencing — that was recently delayed until at least May — some lawmakers are trying to figure out what occurred between the time Comey told Congress the FBI did not believe Flynn lied and the time, several months later, when Flynn pleaded guilty to just that.

None of those congressional investigators has an answer; they're baffled by the turn of events. But they know they find the Flynn case troubling, from start to finish.

I think FLYNN will never be convicted. That’s probably why the FBI hasn’t already pressed charges, or a court room reserved.

It’s not as though FLYNN is not going to show up with his own lawyer loaded for bear. They will eat the FBI for breakfast, for the way this was handled and with Comey himself telling Congress he didn’t think Flynn lied, but mis-remembered, that will matter at court time.

We all heard that testimony. It was on video and LIVE tv.

Others on FR have written that the new judge has had problems in the past with Mueller’s failure to produce exculpatory information in analogous circumstances.

If true, that might be a “simple” explanation. 2nd is the judge is playing for time to see what develops. 3rd is that the judge is setting up an escape hatch for Mueller and the FBI. “Due to our incredible diligence and decency, we found this Previously Unknown Exculpatory Data. Please don’t overturn Flynn’s guilty plea, dismiss the case, seal the records for er, Flynn’s benefit, and throw us in the briar patch...”

Mueller pushed for a guilty plea on the one count because he needed a scalp, and he knew he couldn’t go trial. Too much Brady/Giglio info available to survive a court case. The question is if that plea will stand. I don’t know when Mueller is required to hand over exculpatory info.

YES...Mueller is DIRTY, Comey is DIRTY, the entire FBI upper echelon is DIRTY, the CIA upper echelon is DIRTY. the DOJ upper echelon is DIRTY.......so what is Barney Fife Sessuons going to do about it?? NOTHING!! They must have something on him! WAKE UP TWIT!! You’ve got a job to do!
