The family of a community volunteer killed by a gun stolen from a San Francisco officer filed a legal claim with the city Wednesday, alleging the police department failed to provide proper training on gun storage.
Abel Esquivel, 22, was killed during a robbery Aug. 15 as he walked to his mothers house after working a late shift at a grocery store. He volunteered at the Central American Resource Center, which provides legal help to low-income Latino clients and other social services.
Three men were arrested and charged with murder, including an 18-year-old facing deportation who was wearing a monitoring device so federal immigration authorities could track him.
The familys claim was filed at City Hall and seeks unspecified damages. It alleges that the off-duty officers loaded gun was left unattended in a private car rather than stored in a lockbox in the trunk.
If the San Francisco Board of Supervisors rejects the claim, lawyers said they will file a wrongful-death lawsuit.

Still trying to figure out how a gun does this on its own. Was the gun arrested for murder or is it still a fugitive?
Don’t even try to figure it out.
It’ll just make your head hurt.
I heard they are going to charge the car that had the gun for conspiracy too.
The gun was brought to the scene by an SUV
"...brought to the scene by a SUV..."
But..this...just can’t be! *Head explodes*
Only highly trained polices should be allowed to have guns. /S
What? You never watched THE STREETS OF SAN FRANCISCO or QUINCY, M.E. in which guns escape their owners and go on a killing rampage till captured and melted down into sewer covers?
As Dr Quincy said...”WE’VE GOT TO STOP IT BEFORE IT KILLS AGAIN!”
