Is Secession Legal: An Open Letter to Attorney General Sessions

No, Mr. Attorney-General, secession and nullification are not settled law. Laws against nullification and secession are the illegitimate offspring of the War of Independence.

The Founders were secessionists, no, Mr. Sessions? Were you asleep during your 6th grade history class as much you are today? Every government that exceeds its constitutionally mandated powers is illegitimate. As such, the states are free to go. Haven’t you noticed that the federal government has completely trashed the Tenth Amendment guaranteeing the states and the people the power of authority over those powers not granted the federal government under Article 1, Section 8? When you assert that federal law is the supreme law of the land, are you declaring in essence that the Tenth Amendment is null and void? If so, you are a feckless traitor.

I would under ordinary and legitimate circumstances agree with your position on California’s “sanctuary state” laws and its openly impeding the enforcement of federal immigration laws. The Constitution is quite clear that immigration is an authorized power of the federal government under Article 1, Section 8.

But given the fact that the federal government has so exceeded the powers authorized by USC Article 1, Section 8, so egregiously, so flagrantly, and in so many ways over so many years, and all but ignored our sacred Tenth Amendment, it is clear that our government is illigimate, and that under the circumstances, I cannot support your stance.

Somewhere this is a quote by Jefferson Davis who made clear that even though they lost the civil war, the issues of state’s rights will continue until they are resolved.

....a 6th grade history class would have taught many Californian idiots that Federal Immigration law trumps state immigration law......in other words, its the Federal government’s purvey to dictate immigration policy and law, not the frakin’ state.

There is also no way that kumbaya-land won’t quickly become Mexico-North or Western China, and that’s a thing that the rest of the country won’t be having.

The lunatics can leave the asylum but the asylum itself will stay U.S. property.

Cute. So Mexican Separatism is an issue of State’s Rights?

No Americans in California voted to legitimize the current secession of California. Only an invading population from an enemy nation.

So it’s not legitimate.

You can't truly outlaw secession from a country, because the seceding party is renouncing the authority of the country. The seceding party is already pissed-off at the country, so the seceding party will not care about anything the country has to say.

The Founding Fathers knew that a secession crisis could not be handled via the Constitution. It would have to dealt with by people in the moment. So while the Constitution speaks of secession from a State (Article IV, Section 3, Clause 1), it is silent about secession from the United States.

Pretty well much my thinking. "You get what you can take and you keep what you can defend". Say it to snowflakes, it leaves them stuttering and stammering for something relevant to point out.

On the other hand, there's a constitutional method. The States can dissolve the union.

Obama sued AZ over their enforcement of their state immigration law.

The decision was that the state had no standing and that the federal government had complete constitutional control of immigration policies and enforcement.

That ruling also makes the cherry picked judge’s decisions that attempt to nullify removal of DACA null and void.

They want to have it both ways and they need to bend over and live with the immigration legacy left by their Kenyan, fascist hero.

Oh, and Cali, counties and cities in your state can use your own secession argument against YOU and break from your state as well.

I think secession IS illegal, a violation of the Constitution. However, that does not mean it would always be morally wrong. The American revolution was a kind of “secession.”
