The judge warned Timothy Weiner to stop complaining about his ex-wife on Facebook.
"Neither parent," Pasco Circuit judge Lauralee Westine wrote in her order after the September hearing, "shall disparage or threaten the other parent on social media."
But a week later, a photo of his ex-wife surfaced on a fathers rights Facebook page called "Mothers who abuse kids." Weiner hit the "like" button.
That was enough for Westine to send Weiner, of New Port Richey, to the county jail for criminal contempt.
The judge sent him to jail for 60 days.
The next day, Westine amended her ruling to time served and Weiner was released.
"I absolutely did not expect to go to jail," Weiner said. "My freedom of speech was violated even though I didnt say anything. All I did was like a Facebook post."

when a court tells you not to do something and you do it anyway, you should expect some sort of consequence.
staying overnight in the holding cell sucked didn’t it?
Courts have no right to limit the 1st amendment..........
Idiot was warned
That doesn't sound as innocent as he is making it out to be.
Sounds like either he had someone post it so he could Like it, or someone he knew posted it, then privately told he he had posted it.
The judge is not a judge because he is right; he is right because he is the judge.
Actually they do. Gag orders are pretty common.
Baaaah.
He was not the poster, he made no threatening or disparaging remarks. he clicked he liked someone elses post. that is what a “like” is, you like their post.
The judge knew she went too far.
My mother lives in Pasco county Fl. I have resided their a few times over the years and the Sheriffs department and the courts can be overbearing....jail is BIG business in Florida...don’t kid yourself.
Misleading headline. What a moron.
we all have aright to equal access and a fair trial. If that conflicts with someone’s first amendment right, the judge decides. Gag orders are very common and have been tested,.
Of course they don’t have that right . . . and yet Contempt of Court charges and you go to jail without a trial. Which part of the Constitution does that violate?
You are referring to the judge right?
Yeah, as if the pic of the ex just happened to randomly get posted to a site he frequents and he saw and liked it. For sure he posted it.
So a third party can tell who “Liked” something on Facebook?
I don’t do Facebook. So I don’t know how it works. I’m just surprised that there is an audit trail that is visible.
This implies that someone noticed the infraction and brought it to the attention of the judge.
The poster and the respondents get notices which say So and so liked your reply or your post.
“The judge is not a judge because he is right; he is right because he is the judge.”
Yeah, but it would be nice if they adhered to the Constitution and the Bill of Rights.
How’s he going to earn the money for alimony and child support from jail, judge?
And just how does this help the kids?
Sicko, anti-Constitution judge.
