NRA files lawsuit over Florida gun control law

TALLAHASSEE, Fla. (AP) — UPDATE (6:15 p.m.):

The National Rifle Association has filed a federal lawsuit over gun control legislation Florida Gov. Rick Scott has signed, saying it violates the Second Amendment by raising the age to buy guns from 18 to 21.

The lawsuit came just hours after Gov. Scott, a Republican, signed the compromise bill Friday afternoon.

Lawyers for the NRA want a federal judge to block the new age restriction from taking effect.

The new legislation raises the minimum age to buy rifles from 18 to 21, extends a three-day waiting period for handgun purchases to include long guns and bans bump stocks that allow guns to mimic fully automatic fire. It also creates a so-called "guardian" program that enables teachers and other school employees to carry handguns.

The new measures come in the wake of the Feb. 14 shooting rampage at Marjory Stoneman Douglas High School in Parkland, Florida, that killed 17 people.

The inability to counter this perverted (they call progressive) agenda created by the democratic party ( in name only) has its goose stepping adherents in the media left make it up as guns and the NRA garbage through their swill mills. When it should be contested by GOP state and federal legislators who should be demanding investigative hearings exposing policy failures

Besides examining the conduct and arrangements of the Broward county sheriff’s dept performance failures. A dramatic reduction in disciplinary incidents at Parkside were reported after the selection of Obama’s Chicago friend as school superintendent occurred which was publicly acclaimed.And that school district was receiving large grant money from Obama’s Attorney General because of those results. That many critics claimed encouraged criminal activity. Which should require Trump Administration US Attorney General beside find out why when the FBI knew that Cruz should not be able to purchase weapons did. And review these grant programs instituted by the previous Obama administration.

However, you are required to serve in the military at age 18 years. Then raise the age to serve to 21 years, too.

Seems unfair — demand that a young man serve in the military, yet he is not trustworthy enough to own a weapon.

Also purchasing alcohol is not a right as spelled out in the Bill of Rights.

..... The age of maturity of people has risen drastically over the past decade or so .... And exponential during the previous administration to the point that we now have entire sections of society composed of nothing more than adult babies.

...The maturity level of people that are in their 20's today would be comparable to the maturity level of people in their early to late teens decades ago.

I’d ask the promoters of the legislation if, after this law is passed, they are promising that a situation like happened in Florida will never happen again?

And then take names and promise that blame will directed at them if/when it happens again. The will own it. After all, they promised by passing the law.

IMO, it is both a feel good solution and a misleading lie.

Agreed. This suit is dead on arrival in the courts. Heller specifically stated that some regulation was permissible.

It will be an interesting case.

The GUN CONTROL ACT OF 1968 (federal law) set the ages of 21 for handguns and 18 for rifles and shotguns.

Yes, you are correct. The following is from a Feb. 26, 2018 article on the New Republic site

"America’s regulations on gun purchases don’t make much sense no matter how you feel about the Second Amendment. By federal law, only people 21 and older can buy a handgun from a licensed dealer, but 18-year-olds can buy shotguns and rifles—including the infamous AR-15.

In 2012, the National Rifle Association implored the U.S. Supreme Court to fix this inconsistency—by allowing people under 21 to buy handguns. In its petition, the gun-rights group told the justices that young Americans should not be deprived of their constitutional right to buy a specific class of firearms. “It is undisputed that 18-to-20-year-olds were not only permitted but required to keep and bear arms when the Second Amendment was ratified,” the NRA’s lawyers wrote. A group of conservative attorneys general from 22 states filed a brief backing the NRA’s petition.

For whatever reason, in what has become a trend on gun cases, the court decided not to accept the challenge."

I hate the way the 2nd is constantly whittled away but I don’t want this SC to get another challenge we barely won the last one 5-4 and Kennedy was very wobbly.

I’m not a lawyer, but this effectively means 18-20 year olds cannot own any firearm until their 21st birthday, which I’m not sure is legal. Alcohol, tobacco and driving aren’t constitutional rights.

Explain why not then make it 35. After all, that’s the age the founding fathers penned when a man is almost assuredly of sound mind and judgement, enough to be eligible for the presidency. How about the age of those able-bodied in the unorganized militia, 17 to 64 as is current regulation?

The Const. doesn’t GRANT Rights, but merely reaffirms a FEW of import vs. govt. The Rights of the People are INFINITE; the power of govt are few and defined.

I am so sick of supposed “Conservatives” coming on here and saying, “I’ll vote for a Communist.” Yeah, you will know what you get with Bill Nelson. He’s a baby killing, gun grabbing, anti-Trump lunatic who will do everything in his power to march the country down the path toward Communism.

Do you want more strict Constructionist judges like Justice Gorsuch? Bill Nelson will block every one of them.

Do you want to advance the cause of life? Bill Nelson will push abortion on demand every chance he can get.

Do you want to protect the Second Amendment? Bill Nelson ran out to the media before the bodies were cold in Parkland, calling for an OUTRIGHT BAN, instant felon status on ALL Semi-autos.

You don’t vote for a monster like that, under any circumstances.

If you are mad at Scott, fine! I’m with you. Vote against him the primary. If he wins the primary, vote for a Constitution party candidate or write in a name. But you don’t ever vote for a Communist “because you know what you will get.”

Not if you are a Conservative.
