The difference is that there is no Constitutional right to buy alcohol. There is a Constitutional right to keep and bear arms.

I hate the way the 2nd is constantly whittled away but I don’t want this SC to get another challenge we barely won the last one 5-4 and Kennedy was very wobbly.

Regardless, hope the NRA wins! Scott is done in Florida. Might as well withdraw from the Senate race. I’ll vote for Bill Nelson. At least I know what I’m getting!

Buying alcohol is not a right enshrined in the constitution.

However, I believe the states can regulate weapons sales to some degree.

So, if 18 is too young, irresponsible and inexperienced to purchase a weapon, surely it it too young to VOTE!

You're being a bit naive if you believe the NRA and its lawyers would sue if they didn't think they'd have a case for repeal.

Drinking alcohol isn't a Constitutional law as is the RKBA.

Big difference here. You're right to bear arms is spelled out in the Constitution. Alcohol and for that matter pot consumption is not a right recognized by the Constitution. Hence the Feds or States can outright ban either. We still have counties in some states that are dry counties. No sale or possession of alcohol.

However, you are required to serve in the military at age 18 years. Then raise the age to serve to 21 years, too.

Seems unfair — demand that a young man serve in the military, yet he is not trustworthy enough to own a weapon.

Also purchasing alcohol is not a right as spelled out in the Bill of Rights.

Agreed. This suit is dead on arrival in the courts. Heller specifically stated that some regulation was permissible.

It will be an interesting case.

The GUN CONTROL ACT OF 1968 (federal law) set the ages of 21 for handguns and 18 for rifles and shotguns.

I’m not a lawyer, but this effectively means 18-20 year olds cannot own any firearm until their 21st birthday, which I’m not sure is legal. Alcohol, tobacco and driving aren’t constitutional rights.

The 21st Amendment did more than repeal prohibition, it prohibited violating state laws on alcohol. State’s have much more leeway in setting alcohol laws.

The 2nd Amendment would seem to be violated by preventing people of militia age from purchasing militia weapons.
The 14th Amendment would seem to make the 2nd Amendment something that the state’s must uphold.

Oh yeah.... the old no. 7 ammendment I think: "A well speculated beverage, being necessary to the maturity of a Tennessee spirit, the right of the people to keep and cheer jugs, shall not be infringed."

Then I guess they had better bump the DRAFT AGE up to 21 also.
I enlisted back in 68 so I really don’t give a sh!t about the draft age, but fair is fair.
If the Feds can draft you at 18 in a time of war (or peace time) depending on their needs or desires, then you should be able to purchase a weapon or a beer at the age of 18.
