I do not believe that is how it works. He has his service so far. It is not negated. The question is, how does he get the extra couple of days needed for retirement?
Answer: a friendly congressman hires him for a couple of days. They count for civil service, and the usual rules of hiring do not apply to congress.
Still has to go through the process. Which means the congressman has to post the job internally, McCabe will have to pass a background check and while that is happening, McCabe will not be issued a government ID and Password.
The real crime is how does a govt employee get a full pension at age 49 ?
