They have no authority whatsoever regarding the military. The CiC does, solely and completely as per our constitution.

By his Constitutional authority as Commander In Chief of the Armed Forces. While the lawsuits will come, I suggest he ignore them and continue with this policy. As Andrew Jackson? once said, "They made their [erroneous] decision, now let them enforce it". This is just plain commonsense.
