To answer your question, they would need a warrant, for which they would have to establish probable cause that a crime was committed by the detainee.

It seem Mueller can do whatever he wants. Any complaints and the left screams of “a constitutional crisis” or “obstruction of justice”. The GOP hasn’t the nads to tell them to pound sand. The whole thing stinks, to me.
Mueller needs a warrant to review this man’s cell phone. If he doesn’t have one, I hope Malloch says NO.
As someone who has been through similar detention, etc... Its becoming very clear Mueller is on a political fishing expedition - find anything, on anyone connected to Trump.

He has support from most of DC, but congress is what he’s counting on for “authority”: Pelosi, Schumer, Graham, McCain, McConnell, Ryan.
They’ve said any attempt to stop Mueller is impeachable. So Mueller can pretty much search, seize, subpoena, and probably have anyone arrested for any reason. And the executive branch can’t do anything about it without facing impeachment. And Mueller is taking advantage of that.
Don’t think of writing anything pro-Trump. And accepting an appointment from Trump now means literally having Mueller harass you, your family and friends, and possible rack up lots of lawyer fees for something you didn’t do or something that was legal (and you better not be wrong if Mueller’s thugs question you about it). Muller has gone way beyond collusion investigation. Beyond simply helping Democrats in the 2018 elections. Or even just slowing Trump down. And congress - D and R - supports him.
Mueller should call Alex Jones in to testify, that would be Pay Per View material!
