Oh, it was his "aide de memoire". Glad that clears it up. If he really didn't want it to look like a leak, why didn't he write in big letters on the front: "THIS IS NOT A LEAK!"?

And though it walks and talks like a duck, this is obviously not a duck l’orange.

Of course he said that. It’s not illegal to lie to Brett Baer.

Comey must think a leak is only when you go to the men’s restroom.

The memos were about conversations he had with his boss, the President. Therefore, they were work product. The Director of the FBI does not get to have private conversations with his boss.

Then why did he hand them off?

And if I remember correctly, Comey said the Professor was more than a friend, he was his attorney and the memos were subject to attorney-client privilege.

Now, out of the clear blue sky, we find out that, somehow, the Professor had a free pass for FBI access.

Comey KNOWS that his memos are “WORK PRODUCT”, prepared in the course of performing his FBI job.

He signed a Non-Disclosure Agreement both upon entering the service of the FBI and again upon his departure. That NDA makes very clear that ‘work product’ is government property and may NOT be retained or disclosed to those outside the agency.

If it was a legal release why did it have to secretly go through his bag man rather than mailed directly to the New York Times on FBI letterhead?

Can't use that excuse. He forwarded all the memos to other FBI agents AND asked for their advice as to whether his Secret Classification was too high or too low.

We need their response. That's one of the things we're missing.

It's a small point, but you can tell a lot about a person by odd phrases and ... not the meaning of the actual words ... but the meaning of why he uses them.

"It was my personal aide de memoire."

This is a total signaling effort - that he seized on this at some point in his life as an effective phrase. There is nothing wrong with being low class or not that smart, but there IS something wrong with hiding it by signaling that you are not low class or not that smart. It's just ... low class and not that smart.

Comey often signals his insecurity with these phrases - he thinks the elite use them, he wishes he were elite, and he pretends he is.

It's a little like people using 'whom' as the subject of a verb, thinking the mere tacking on of the 'm' makes them high brow. It may even be effective among their peers, but it marks them as a faker since they don't know when to use it.

I can say all this without being snotty because first of all it's true, and second of all, low/high class, smart/not-smart don't really matter and don't really exist. Certainly they have little bearing experiencing a good life helping others to do the same.

This guy ... he's just ... so very lame. He is as tragic as he thinks he is great, and even in thinking he is great, he believes it is partially because he is so humble.

He's a GREAT study in man's ability to lie to himself semi consciously - to cast himself in an illusory story where he is a hero and all of what look like misdeeds and character flaws to the unwashed, if one knew the real conditions - as Comey often says "well what I was thinking at the time," are exceptions that prove the rule or extreme circumstances emphasizing the nuance with which a truly moral person must deal, often choosing the apparent (to the un-morally-washed) wrong action which is actually the right action.

Much better to just be a dumb humble schmuck trudging through reality. But no, Comey at some young age cast himself in a tale that explained his insecurities and made him ... a great man!

Why does this guy think he will skate?

It’s one thing to leak and then shut up and go into hiding. But this guy is putting himself out as a target #1. If he’s not charged and convicted, a lot more people will be even more incensed at government.

This guy already has plenty of money. He’s not doing this to take a bullet for the Klintoons and go to jail.

At least in one sense, he’s doing a service to the country by showing the people the unlimited arrogance, deceit and treachery of government officials. The confidence and trust in government institutions and agencies will plummet to all time lows.

Without public support, confidence and cooperation, these agencies will implode.

“But isn’t a memo of the FBI director’s conversation with the president of the United States considered “work product”?”

That was a key question. Of course it was a work product and represents notes that are subject to subpoenas and the like.
