Budget Rescission: Early May Deadline
Congressional Record ^ | 1974 | US Congress

Posted on 04/29/2018 8:56:11 AM PDT by research99

Checking the Congressional Budget Act of 1974 (Public Law 93–344, 88 Stat. 297, 2 U.S.C. §§ 601–688) online:

Part B, Section 1011-1012 and related (identified elsewhere as Title X) within the Act (also known as the Impoundment Control Act of 1974), specifies that the President may request that Congress rescind appropriated funds.

The timeline for approval by both the house and senate is 45 days.

The budget was signed on March 23rd, so a 45-day deadline for action under the rescission statute would be about May 8th.

Rather than just talking about shutting down the budget process in September to get action, budget items from the bloated "Paul Ryan Omnibus Act" could be de-funded with a mere majority vote, so long as action occurs within the next 10 days.

I doubt it. I'd like it, but I doubt it. We need a real rather than a paper majority to get the budget cuts we need. Thanks research99.

Ronald Reagan used rescissions to save billions of dollars. Over his eight years in office, Reagan proposed 596 rescissions, totaling $43 billion. Congress ultimately approved 213 of Reagan’s rescissions, for a savings of $16 billion — or roughly $34 billion after adjusting for inflation.

Sadly, in the years since Reagan left office, Congress has approved less than $6 billion worth of additional rescissions. According to the Government Accountability Office, no president has submitted a rescission proposal since fiscal 2000, and Congress hasn’t approved one since fiscal 1999.

The 45 day deadline is after ...

(a) Transmittal of special message

Whenever the President determines that all or part of any budget authority will not be required to carry out the full objectives or scope of programs for which it is provided or that such budget authority should be rescinded for fiscal policy or other reasons (including the termination of authorized projects or activities for which budget authority has been provided), or whenever all or part of budget authority provided for only one fiscal year is to be reserved from obligation for such fiscal year, the President shall transmit to both Houses of Congress a special message specifying ...

I don't know what, if any "special message pursuant to the Impoundment Act" has been transmitted from President Trump to both Houses of Congress.

Sure enough, 45 days later and a rescission package has been announced.

Sure enough.

And also sure enough, there is a 45 day time window for Congress, which comes AFTER the special message is transmitted.

The timeline for approval by both the house and senate is 45 days.

You assigned May 8 as the end date for that 45 days. The house and senate have not approved the rescission request. Looks like it fails, eh? Just kidding.

If there is a deadline for the president to submit the special message, I'd like to be referred to the specific clause in the statute that imposes that deadline. As far as I know, Trump can send another special message relating to rescission, even though the appropriations are more than 45 days old.
