Kennedy cousin Michael Skakel's 1975 murder conviction vacated

HARTFORD, Conn. (WTNH) - The Connecticut Supreme Court has overturned the 1975 murder conviction of Kennedy cousin Michael Skakel.

The Hartford Courant reports that the Connecticut Supreme Court voted 4-3 that Skakel's trial lawyer was so ineffective, that his right to a fair trial was violated. Skakel was convicted in the murder of his friend, Martha Moxley, when the two were neighbors in Greenwich.

Skakel has been free since late 2013 while the court considered this latest appeal. He is expected to remain free unless state prosecutors make what many lawyers predict would be an unlikely decision to retry him on decades-old evidence, the Courant reports.

News 8 spoke with Robert Kennedy Junior Friday afternoon. Upon hearing the news of the court's decision, Kennedy expressed his satisfaction.

"That's fantastic... It's been a long hard fight for justice. Michael Skakel was framed by corrupt prosecutors. This is his vindication."

Oh Skakel was guilty as they come.

I meant William Kennedy did not rape the woman in Florida. Testimony in the case including from JFK Jr. showed they were just plain trashy.

I bet they all were grateful for the discovery of penicillin.

I was in Georgetown Hosp. as a patient, during his internship. One of his colleagues (during rounds) felt compelled to introduce Smith as “a Kennedy”. I made some sarcastic remark through my mask, IV drips and bandages;) LOL!!!!

Over the years, both Thomas and Michael Skakel significantly changed their alibis for the night of Moxley’s murder. Michael Skakel claimed that he had been window-peeping and masturbating in a tree beside the Moxley property from 11:30 p.m. to 12:30 a.m...

I gotta admit...I've heard better alibis. Much, much better, in fact.

Would you and I get convicted and released with the same lawyer? Probably.

Convicted yes. Released? No. Kennedy is part of the Aristocracy.

You can hate the player, but this wasn’t some on the take county judge.

Not sure I understand your point here. The evidence i've seen is that the Kennedys have influence with the highest authorities in the land.

Skakel, in prison since a conviction in 2002 for killing his neighbor
when they were both 15, was serving a sentence of 20 years to life.

He had to concoct an alibi like that because he needed to come up with an explanation for the, uh, “DNA” they found at the scene.

I never followed the case closely. Had Martha been raped before the murder?

So if you want to have a conviction vacated just hire an incompetent lawyer in Connecticut?

This is why a new trial is *not* granted when "new evidence" is uncovered. It is incumbent on the defense to present its *entire* case at the original trial, rather than get repeated bites at the apple. His lawyer may have felt that presenting a weak alibi (masturbating in a tree outside her window) might do more harm than good.
