I’m black and I’ve been saying this for years. It’s sort of too late now, but I was thinking of it as analogous to how tribes in some places have a monopoly on gambling.
Actually Treaty Tribes have their so-called monopoly enshrined in the Constitution which grants them Rights, but mere privileges for every one else regardless of race, religion place of origin - so sayeth SCOTUS.
That is also why the Treaty Tribes have a monopoly on selling fireworks available no where else, tax-free tobacco, special hunting rights, Endangered Species Act waivers, and pay no federal income tax - among many other Rights granted only to them.
