(KUTV) A 12-year-old autistic boy was placed in a Juvenile Detention Center on Monday after brandishing an imaginary rifle at his art teacher, FOX 26 reports.
The 5th grade teacher reportedly felt threatened by the child, identified as David Sims, who was arrested by a school police officer.
"She (the officer) just put handcuffs on me and told me I need to go with her," Sims said.
"They just said, 'We don't tolerate that. We take it as a threat,'" said Amy Sims, the boy's mother. "A threat? He didn't threaten anyone. He didn't do anything but play."
Amy Sims was not informed of the incident until her son was already in custody, FOX 26 reports. The mother states that because of her son's condition, he does not understand that "make believe" gunplay on school grounds has become a sensitive matter.
"Being put in handcuffs, not knowing what he did wrong, I could have had a talk with him and told him, 'Look, I know you like to play guns, but you can't do it in school,'" Amy Sims said.

No state is all red or all blue, especially in a public school classroom that are taught by products of education departments of colleges and universities.
Bullying chickenshit teachers are another reason to homeschool.

Any parent who enrolls their autistic child in a public school is guilty of child endangerment. Exceptions prove the rule.
Public schools are dangerous for children.
Apparently, common sense is not common anymore.
It would have to be under some federal statute. Under the Texas Tort Claims Act, Texas school districts and their employees can generally only be sued for motor vehicle accidents.
Sounds kinda like the kid that that bit a toaster pop tart into the shape of a gun and was expelled. This is what an unnatural fear of guns causes!!!

this is insane. I have speculation about what actually took place. autistic children are hard to deal with in the classroom. what I think actually happen was that the teacher decided to use this instant of play by the kid to have him removed permanently from his or hers classroom. the reason why is that now the kid will not be in her classroom for the rest of the year and not be his or her problem.
of course this is just speculation.
The mental defect appears to be spreading. Shame.
Not that long ago boys would play cowboys and indians and war all the time with no one giving it a thought. Now they arrest and throw them into cuffs.
