I wonder if does it matter? Consider McCabe. McCabe was fired for "lacking candor" even when he wasn't under oath. In the FBI, "lacking candor" is grounds for termination and considered a close cousin to perjury.

Correct. A retired agent told me that within the Bureau the words lie and perjury are never used in official reprts and otherwise. Lacking candor is always used instead. It protects the agents from prosecution but it allows termination or suspension. In reality, it’s perjury, but not prosecuted as such.

Lying to the FBI, even if you are in the FBI, is a federal beef.

Failure to prosecute same is selective prosecution.

It doesn’t matter to me. I expect these guys to act honorably.

As for it opening them up to official problems, you make a decent case for it considering what happened to McCabe.
