A former California Highway Patrol assistant chief and his estranged wife pleaded no contest on Monday in Fresno Superior Court to a felony conspiracy charge for helping their son escape to Mexico during his rape trial in 2012.
After their pleas, Judge John Nip Gallagher ordered Kyle and Gail Scarber to each perform 500 hours of community service and pay a total of $10,000 in restitution to the state of California for its criminal investigation.

Sheldon K Scarber Title: ASSISTANT CHIEF, CALIFORNIA HIGHWAY PATROL Employer: DEPARTMENT OF CALIFORNIA HIGHWAY PATROL Pension: CalPERS, 2017 $127,775.25
Not a single day in jail. Wow. And whores around for $127,000. a year.
Speaking of fleeing prosecution, what are the current odds on Harvey Weinstein doing a long term vacation in Paraguay?
It is actually more than that. He sued for a disability retirement because he once saw something that upset him, so he gets 50% of that tax free.
If they complete community service and pay the restitution, Kyle and Gail Scarber will have their conviction reduced to a misdemeanor
Gail Scarber also faces additional felony charges of forgery for allegedly manufacturing a false birth certificate for her son and forging a seal of the Orange County Recorders Office. In addition, Kyle Scarber was charged with filing a false police report for reporting his son missing after the familys car reportedly crossed into Mexico.
In his ruling, Hamlin said Kyle Scarber lied when he called authorities on the morning of Dec. 12, 2012, to report his son was missing and possibly kidnapped when he knew Spencer Scarber already had crossed into Mexico.
Hamlin also said the evidence suggested that Kyle Scarber staged a crime scene outside his Squaw Valley home to make it appear that his son had been kidnapped.
Community service for forgery, false police reports and helping a rapist leave the country?
Do not try if you're a private sector tax payer, as you will not get a fine and community service sentence. Just wow.
Unreal. You can bet if the guy weren’t a LEO he’d be doing time.
” He sued for a disability retirement because he once saw something that upset him, so he gets 50% of that tax free.”
Sued? I thought 100% was a given!
Remember, this is California, a state run by rabid leftists where the rule of law only applies to whomever the ruling class deems appropriate or necessary.
There was an article in the SacBee some time ago that suggested even the board considering the disability retirement was not happy with his claims but said they couldn’t do anything to stop it. There is also video of him whining to the board about why he Deserved it.
The boy still in Mexico?
Egans staff prosecuted Spencer Scarber for four months before they turned the case over to the state Attorney Generals Office. But even then, according to court records, the state prosecutor, Leanne LeMon, was married to Carl Monopoli, who was a prosecutor in Egans office. Monopoli remains a prosecutor for current District Attorney Lisa Smittcamp. LeMon is currently a Fresno Superior Court judge.
There it is again, all these people in local/state and Fed governments are all connected in one form or another... married, banging each other, related in one form or another on and on.
I kept reading the article in utter amazement. Amazing.
I live and work in California. I have to get up early to head off to work so I can pay for this pant load’s tax free 6 figure pension.
Ex-CHP chief snared in sons escape from rape trial seeks disability pension
A former California Highway Patrol assistant chief who allegedly helped his son flee to Mexico after being accused of rape is eligible for a tax-free disability pension because the state agreed not to discipline him when it accepted his resignation four years ago.
If he hasnt changed his name to Gomez and snuck over the border.
wrong link try it again
It’s that way all over the country, not just California.
No. They caught and extradited him. He is doing 35 to life.
