you commit the crime of negligent discharge of a firearm if you: - Willfully discharge a firearm", ...
The words "Willfully discharge" may be very arguable in this case. It sounds to me like this law is more meant for a case when someone goes outside on New years and decides to celebrate by shooting into the air or into a hill and the round injures someone. The law seems to indicate you must "willfully" discharge the weapon and in this case it could be argued he did not do so. I think we might be back to accidental discharge.
Not trying to argue. I just find this interesting.
I saw the video more than a couple of times. When the doofus picks up the pistol, his finger is inserted into the trigger guard. He then tightens his hand to grasp the pistol, and that’s when the round is discharged - his finger has complete access to the trigger and his hand is being tightened. Conclusion: he pulled the trigger.
Dork.
Although this was a negligent discharge, not an accidental discharge I agree with everything else you wrote.
They are deliberately over-charging him so he will get off clean. They really are protecting their own.
Seems like the bureau is giving him up. Otherwise they would have fixed this with the local authorities and shipped him back to DC. Probably has a rep as a clown.
Yep. If it was any one of us we would have walked out of that place in handcuffs and still be in jail.
After watching the video a couple of times I think his worst punishment is that this will be around FOREVER-—he will never live this down.

Well...I’ve carried in my pocket....but never tucked into my pants...
That was like a WEEKJ AGO!!! The FBI is a little SLOW on the UPTAKE.....UNKESS it’s a Republican!
For some it is ‘sentence now, trial latter’...
‘besides, that’s not a regular rule: you invented it just now. ...
“What kind of a moron carries concealed by tucking the pistol in his pants back waistband with no holster?”
Mexican carry is legitimate in some circumstances, with some pistols and some clothing. But it is never legitimate to be dancing like a homo, and doing a backflip, while in a nightclub while using “Mexican carry”.
It is a more discrete and discerning carry, and lightning fast...but you have to remember it’s not good for running and backflipping.
“I agree that the gun term “negligent discharge” applies here but that’s a gun community term.”
SHAME on you. You didn’t use the latest updated tacticool terminology!
he would alright till he tried to pick it up in a hurry and it went off...
Very true. And all kinds of training tells you not to EVER make a grab for a falling gun. For exactly -this- reason.
What a doofus.
Totally agree!
+1 that's exactly what I said also.
