Letter: High court ruling on flag burning may quiet anthem uproar

The Supreme Court ruled that the government can’t ‘prohibit the expression of an idea simply because society finds the idea itself offensive.’

The current brouhaha ignores one of our fundamental rights, the freedom of expression (speech). In its 1989 decision, Texas v Johnson, the Supreme Court ruled, “Government may not prohibit the expression of an idea simply because society finds the idea itself offensive or disagreeable.”

The court determined that publicly burning the American flag was protected speech. It would surprise and shock conservatives to learn that Justice Antonin Scalia sided with the majority opinion.

Rather than condemn the athletes kneeling during our nation’s song, we should celebrate the absolute right to that discordant idea. Such provocative conduct in China, North Korea or Russia would find the contrarians in prison or dead.

Doesn’t have a thing to do with the government.

Unless the author thinks the government should force us to buy NFL tickets the way it forced us to buy medical insurance.

no one is prohibiting anything rather just implementing their 1A rights and speaking out against what we see as insulting to our nation...

He also doesn’t understand that the legal right to do something, does not equate to the legal right to force others to go along with it.

Exactly. Free speech is constitutionally protected only from government action. These days, everyone is a constitutional scholar without even reading it.

They can protest all they want, ON THEIR OWN TIME!

When you work for your employer, you’re free speech protections can be restricted. Hence why you don’t shout fire in a crowded theater.

I agree entirely with the statement made by a FReeper that ‘the NFL is not the government’.

Beyond that, there is a lot to think about in the context of this SC finding. This SC decision asks many questions about concepts such as ‘hate speech’, and where the line is drawn between ‘protected speech’ and treason.

That ruling is another mistake by the Court in a long line of rulings guided by inadequate reasoning.

I make additional reference to the tortured, mental machinations of Justice Roberts and Obama care.

But is does reveal that “govt is the solution to everything”. Many here on FR think the same.

I have been told that “our laws are better”

The idea of “the invisible hand” is foreign to many.

Like anyone who works for someone, they (employers) make the rules. When on your own time you still better watch what you say, or do, as they can also fire you for expressing those discordant ideas that they deem unacceptable. Freedom of speech does not mean there will not be consequences for exerting that right. Freedom of speech means that governments cannot file criminal charges against you for espousing things that society may find unacceptable.

That is the first thing I noticed too. The NFL is an employer who may make rules of conduct for their employees while employees are on the job.

What’s the SB (i.e., Senate Bill) Number to prohibit taking knees?

Oh, there isn’t one. Then what’s the HB (i.e., House Bill) Number to prohibit taking knees?

Oh, there isn’t one. Then what’s the EO (i.e, Executive Order) Number to prohibit taking knees?
