Some people seem to make a big issue of the affecting interstate commerce. That element was included for the sole reason of being able to claim the statute fell under federal jurisdiction. The interstate commerce require is de minimus. This means that even the remotest connection to interstate commerce is sufficient to meet that element of a RICO violation.
As an example, a court can be a RICO enterprise. Judges order supplies, computers,pens, paper, etc. That is sufficient to meet the affecting interstate commerce element.
