What constitutional rights do undocumented immigrants have?

On Sunday, President Donald Trump tweeted that undocumented immigrants should be immediately returned “from where they came” with “no Judges or Court Cases.”

This, along with the administration’s “zero-tolerance” immigration policy and the recent spike in family separations at the border — a practice President Donald Trump ended through executive order — has called attention to the legal rights of immigrants under U.S. law.

What rights do undocumented immigrants have to a court hearing, to an attorney or to free speech? What rights do their children have to education?

To answer those questions, we must start with a more basic question–does the U.S. Constitution apply to undocumented immigrants?

“Yes, without question,” said Cristina Rodriguez, a professor at Yale Law School. “Most of the provisions of the Constitution apply on the basis of personhood and jurisdiction in the United States.”

Many parts of the Constitution use the term “people” or “person” rather than “citizen.” Rodriguez said those laws apply to everyone physically on U.S. soil, whether or not they are a citizen.

So, why should stepping over the line give an invader rights?

That is right. Only citizens have rights under our Constitution.

When Roe v. Wade was decided the Supreme Court made unborn babies non-legal entities by removing their "personhood" - which is a legal term.

That's the penumbra.

Why should illegals have more rights than an unborn citizen?

Undocumented Immigrants are a rare breed. Like Unicorns.

All immigrants I ever heard of are, by definition, documented. They went to a consulate, applied, waited for approval, became documented, and then... entered.

The whole question is twisted. When someone presents themselves at the border, does that mean they have rights and can play the system like a citizen? What if they illegally enter? Or, if they illegally stay (miss court, skip deportation, etc.)?

Would love to see the interpretation be that anyone not legally in the country is not covered by our laws--treat them as enemy combatants if we have to. At the border or when they get caught, they have no rights and should count their blessings they were not shot and killed. Send them home.

If we have given them permission to be here, guess they need certain limited rights.

Precisely. That is why the wall is an anathema to the one-worlders, Bushites, Leftists, pinkos, Kristols, commies, and neocons.

The leftists gain power by leveraging ambiguity, and gaming the semantics of statutes. They are enthralled with word games—"what the meaning of is is".

A wall would be a clear boundary between invaders and Americans. No gray areas to exploit.
