Supreme Court deals blow to public-sector unions, ruling against 'fair-share' fees

The Supreme Court ruled Wednesday that pubic sector unions for state and local employees can’t force non-members to pay a “fair-share” union fee.

In a 5-4 ruling Tuesday, the court said the extraction of agency fees from non-consenting public sector employees violates the First Amendment.

The case centers on an Illinois law, similar to those in 22 other states, that allow public-sector unions to collect a “fair-share fee” from employees for non-political activities like collective bargaining, regardless of whether those employees belong to the union or not. Mark Janus, a state child support specialist at the center of the case, argued against having to give up about $45 from each paycheck to the American Federation of State, County and Municipal Employees (AFSCME) Council 31. Doing so, he said, violates his First Amendment rights because it forces him to support the union’s messaging.

The union, AFSCME, argues it needs the “fair-share” funds to offset the significant costs it incurs negotiating working conditions for all employees. State laws allowing unions to collect these fees are justified, the union said, to avoid a situation where nonunion members get a "free ride."

A group of 15 public sector unions, warned the court in a friend of the court brief that eliminating fair-share fees would eviscerate public sector unions, depriving them of resources they need to perform their essential public functions.

“The elimination of fair-share fees would create an all-or-nothing choice for the workers whom unions represent: pay union dues or pay nothing but still receive the benefits a union provides,” they wrote.

“In that world, many rational employees will choose to become free riders.”

My daughter used to live in Oregon, I love it there. Beautiful beaches, etc. Hopefully this ruling will help make Oregon great again! Maybe even my home State of California!

In addition to fully appreciating the Court's wise decision here, and its bravery in overturning its own faulty Abood decision, I am imagining how plaintiff Mark Janus must feel today, having won an historic Supreme Court case all by himself, more or less.

Decision affects mainly huge public sector unions in Blue states in NY, PA, IL, CA, OR, WA. Unions expected to lose up to 300,000 teachers over next two years.

Varney is astounded and guests are giddy!

On average govt employees make more than private business workers anyway

Many an article has been written about the new elite. Who ae they? Union pensioners who often retire at 55 and move to Florida and golf every day living off of a fuzzy math defined benefit plan that is bankrupting their home city or state as they collect way more than any sap saving in a 401k over their lifetimes AND often enjoy government subsidy for healthcare until 65 when they get formal government healthcare.

They sound like this is some sort of a “bad thing!” So they see themselves as some sort of a “public do gooder?” The only “public function” I see with respect to PE unions is their ability to separate the taxpayers from large sums of money for laziness, featherbedding, shoddy work and violence when they don’t get their way.
The RATs are going to be taking a “pay cut!”

No other reason for it. Public unions I think were started during Kennedy years. Not fair. The employer is the American people, and we have no say.

Look at Chicago. Daly, both of them, gave the unions what they wanted year after year.

Haha...you were on an Oregon beach in the three months of July, August or September....right? On another note, we may STAY here if we get a GOP Governor in November...if we do not...we may be gone....tired of the craziness.

Unions no longer offer any value to a hard worker, only to those who want to barely get by and insist on their breaks.

In NY the hospitals are now being targeted so that nurses can get more breaks, just like teachers.
