Rush just announced Anthony Kennedy is retiring
CBS Portnoy tweets: Trump will appoint from The List, so he tells NBC pool reporter.
Kennedy wrote the opinion in the gay marriage case, and was the deciding vote in several 5-4 decisions, he’s no conservative.

Kennedy drove us up a wall more than once with his decisions, but we should thank him for retiring with a Republican in the WH.
The nuclear option was triggered by the Gorsuch nomination and approval. The nuclear option is still in place for the next one unless the Republicans revoke it and change the rule back to where it was prior. For now the rule is in effect if I'm not mistaken.
