Kagan is no longer a reliable liberal. She’s no conservative, but she’s not rabidly liberal like Sotomayor and Ginsbgurg. Kagan did not side with Sotomayor and Ginsburg on Masterpiece Cake Shop and she wrote the opinion of the Court in Lucia v. SEC.

It would firm up the 5-4, reducing the 4-5 decisions when Kennedy flips. It won’t be until Ginsburg (85) or Breyer (79) that it will be 6-3. Or if both retire while Trump is still in office and Repubs hold Senate majority, it would be 7-2.
