Well you are not wrong about that loser. Likely McConnell can control him though.
Eisenhower made recess appointments of SC Justice William Brennan. Subsequently confirmed.
Very risky politically however, and the GOP Senate would have to cooperate. Note that the Senate has not allowed official recess so far so as to protect AG Sessions.
The Senate can block recess appointments by either holding pro forma sessions, or simply adjourning ‘sine die’ which terminates the Senate session completely.
Dems are not the problem here.
