I would advise people to stop listening to Dershowitz. He was on the View and he sounded much different than when he is championed on FOX.

It was basic math. Trump loses one GOP vote with Kavanaugh. He’d lose two or more with Barrett and that would put the nomination at risk. I see McCain resigning if he can’t make the vote, freeing up his replacement to vote, and Pence casting the tie-break vote. And that assumes no Dem Senators seeking re-election in Trump states break ranks with Schumer.

Did not read the whole thing but I feel personally that Dershowitz is wrong on support for Abortion as it stands, with a lot of restrictions not as birth control it may survive but the numbers would be drastically reduced.
As to the Barrett play, yes, Trump worked them good with his only bullet before the Election. In another article posted here on FR I see that even Schumer has his tail between his legs, there is really no winning position for him especially if Kavanaugh avoids jumping on Abortion and as I stated in another post it erupts from a lower court but cannot originate under any circumstances as a dictate from SCOTUS as they are not allowed by law to just jump in first.

If a State starts a suit to limit or abolish Abortion the fuse is lit, and it goes to SCOTUS and then we are getting somewhere

Trump was never going to put a fourth woman on the court. If Ginsburg, Kagan, or Sotomayor leave then maybe.
I believe Trump passed over Barrett because she hasn’t been at the appellate court level long enough to build a track record as a Federal judge that would demonstrate her legal philosophy.

Barret may personally believe that all abortions are murder but I doubt that she believes that abortion could be made totally illegal by federal judicial writ.
For a couple of reasons I think Dershowitz is wrong on her and Roe.

She clerked for Scalia for a time. Scalia was like her a devout Catholic. For all his disagreement with Roe, he did not think the Constitution alternatively had any mandate to ban abortion. As a Constitutionalist, like Barret, his view of Roe came from his view of the Constitution, in which he saw it silent and mute on aborion with no Constitutional mandate for or against it. Roe was wrong he said because their was no mandate for any Surpreme court decision mandating it be legal or mandating it be banned. I think Barret agreed with that and Dershowitz does not know what he’s talking about when it comes to Barrett’s thinking on Roe.
I think Dershowitz, and many others are making excuses, because growing Conservative analysis of Kavaenaughs federal case history is suggesting a “moderate” Trojan horse wrapped up (by the GOP establishment) as a “staunch Conservative” as “gift” to Trump.
Let President Trump say he was inspired by the Democrats and gives them credit for appointing Thomas Hardiman, Amy Coney Barrett, Amul Thapar, AND Ann Coulter.

He may well be right. Makes sense, and shows strategic thinking by Trump.
Here’s what I appreciate about Dershowitz- he has reasons for his ideas and is able to articulate them. He does not resemble the left of today in any way. He’s essentially homeless.
The new left emotes, reacts and distracts. Instead of reasoning and talking about ideas, they resort to the personal in brilliant use of Alinsky tactics.
Dershowitz tells you what he believes and why. I think most of his beliefs are incorrect, but I respect his old-school ways.
I used to have liberal friends like Dershowitz. We would debate and argue and have interesting conversations. I loved them, they loved me. Now? It’s a measure of how greatly we’ve changed as a country that none of us speak to one another. It began after 9-11.
I would be willing to bet most Americans dont know if Roe v Wade is struck down, it simply sends the issue back to the individual states to decide. The rhetoric makes it sounds like overturning it would outlaw abortions and that is not true.

I heard Dershowitz. He believes there are three main views on abortion — status quo, leave it to the states, and outlaw it nationwide. I don’t see “outlaw it nationwide” happening.
Dershowitz is a smart man and is usually worth a listen. He is not always right but he is not your typical blind democrat partisan either.
Trump is smart too. He needs to manage his political capital wisely to ensure he gets elected again so he can get one, two or more SC justices confirmed. Of course that only happens if Republicans keep the Senate. Without the Senate Trump will not get any more SC justices approved -— period. It will stay 4-4 until he is gone.
Is it correct to assume, as so many seem to, that only death can end a Supreme Court justice’s career?
Don’t the justices have to be physically present during arguments before the Court?
It’s one thing for RBG, for example, to fall asleep during Court sessions, but it would be another thing if she were in a coma and had to be carried in and out of the courtroom on a stretcher by EMT personnel.

Hes right. Except that I dont think Barrett will vote to make abortion illegal under the Constitution. Even before Roe it was a state law issue, not a Constitutional issue.
Dershowitz voted for Hillary Clinton and donated to her campaign, he proudly admits. Just another Democrat fool, no matter what his diplomas say.
