Avenatti: I’d Consider Representing Cohen If He’ll Turn on Trump

My advice to Michael Cohen: DO NOT hire Michael Avenatti as your lawyer. He doesn’t have your best interests at heart. To the contrary, he would use you to advance his own ambitions.

That became obvious by Avenatti’s own statement on Joy Reid’s MSNBC today. Asked by Reid whether he’d represent Cohen, Avenatti said:

“The only way that I would agree to do that is if I had 100% confidence that Michael Cohen was ready to do the right thing: fully disclose what he knew about the President, and if he sought my assistance in bringing that information to the American people and divulging it all: putting it all on the table.”

Michael Cohen would be making a huge mistake by hiring Avenatti as his lawyer. Avenatti makes clear that he would only use Cohen to attack Trump. Avenatti could care less if that would harm his client Cohen’s interests.

Agreed, and his statement is so egregious. He wants Cohen to agree in advance to publicly divulge everything he knows about Trump, even if that would run counter to Cohen’s interest.

Avenatti thus violates his duty to his client. Outrageous. Stay away from this guy, Cohen: he’d only exploit you and sell you down the river on the altar of his own ambitions.

It is the duty of a lawyer to steer his client clear of violating the law.

It is a great abuse of trust for a lawyer to secretly record his client, most especially in the hope of getting the client to agree to commit a crime.

Of course, no payment was made and no violation of law was made by the client.

And even if payment was made, it would be in connection with the election of electors, which is governed by state law under the Constitution.

Also at the time, Trump was considered by almost all reputable experts to have no chance of winning. At that time, Trump was really only exercising his rights to political speech.

Also, these campaign finance laws seem to only trip up outsiders and are almost certainly unconstitutional.

The FEC has the default duty to investigate possible federal campaign finance violations. Possible violations are by default federal law outside of DoJ and Mueller’s reach. The FEC could ask for DoJ assistance, but I don’t believe it has, probably because FEC enforcers would be out of jobs that require only six months of work every two years if campaign finance law is declared unconstitutional.
