yes the guy was shoved, but the man who shoved him clearly was no longer attacking or engaging him in an intimidating manner once he was on the ground.

I have to disagree. He was still walking toward him until he saw the gun.
However, there was also no reason to shoot him, as long as he was retreating from the gun.
A gun is not a bargaining tool, nor it is a tool to scare people with.
One pulls a guns and points it at a person because why?
