Immigration and Customs officials said that Wisner Desmaret is an undocumented immigrant from Haiti.
It could take months or it could take years for Desmaret to face possible deportation for being in the country illegally.

Illegal alien is the correct term.
That is their legal status.
Immigrants are people who apply, pay their fees, wait their turn, learn the language and comply with the laws.
Anyone here illegally, whether they broke in or overstay a visa, is an illegal alien.
