The response to the question of why Manafot was not charged previously will be: new evidence has come to light.

the judge will see through that as being BS, the jury may not.

As I have listened to this I have wondered a lot.

Why is the Mulehead team involved at all in this?

If Manafort was investigated prior why did it take mulehead so long to “find” this and why is it being persecuted if the investigation so long ago EXHONERATED Manafort?

DOJ and the swamp snakes are out of control. Who can and will end this charade?

After both sides conclude presentation, there will be a motion for the judge to take the case away from jury ... Motion for a Judgment of Acquittal.

Come on folks. He was not prosecuted. That doesn’t mean he was exonerated or is innocent. The justice system, at every level, makes decisions on what cases to pursue based on probability of conviction, cost, political ramifications etc.

He was involved with Podesta and is in a position to mount a formidable defense due to his access to resources. Not worth the effort at the time. Now, with the association to Trump, definitely worth it. Remember, this is theater. The media almost universally talks about this trial as the first step in uncovering Trump/collusion....because it fits their narrative and the low information voter simply needs a piñata to believe it is true. Manafort is the piñata. Easy to hate rich, powerful white guys who made millions dealing with foreigners.

If it’s anything like Conrad Black, they’ll dismiss everything but a small technical charge, and the jury will convict because the guy happens to be rich or white or whatever.

Well, in that case Hellary should be immediately indicted for crimes she committed and which “no reasonable prosecutor” would have prosecuted her for earlier.
The Statute of limitations for her classified documents crimes is 10 years and it is running now.

I am not a lawyer nor did I stay at a HI Express last night but I think motions to dismiss are pro-forma and must be filed in order to have a legal foundation for appeal as is the next Acquittal motion.

But thanks for the update about that next step.

What is your reading? I think (of course) this is going to evaporate.

Nope. Never going to happen because it would backfire terribly against the defense of they tried it.

On direct, Rosenstein would testify that Manafort was not exonerated, they just were not able to gather sufficient evidence to prosecute Manafort. That would then open the door for the protection to have Rudenstein basically summarize their entire case on cross examination. “We would have prosecuted then if only we had been able to show then what we know now, that [insert prosecution’s closing arguments].”

And it’s likely they’re not done. Anything “new” about Trump that Manafort may reveal from here on will be highly suspect. Will Manafort make something up, just to get out of solitary and to get his freedom back? I forget the term he used but Dershowitz mentioned as a legit concern that a desperate POW might make up just to ease his plight.

Foudation for appeal is any error by the trial judge. That error might be made in response to a Motion to Dismiss, but isn;t necessarily made there. Appeal could be based on not excluding evidence, or improperly excluding evidence, or any one of probably hundreds of possibilities.

In short, a Motion to Dismiss or a Motion for Acquittal aren;t necessary for an appeal, but they do create additional possibilities for grounds or basis for an appeal. No competent defense lawyer would NOT file those two motions.

I don't think the judge will grant the Motion for Acquittal. He denied the Motion to Dismiss. What will the jury do? I predict a mistrial. Inability to reach a verdict. Up to Mueller what to do from there.

It’s actually frightening, and honestly not much different than what occurred in the Soviet Union.

The biggest general defense against this in a free society would be the outrage coming in opposition by the public - but this won’t happen unless the public knows the truth, and if you’re a conservative and being prosecuted by the left the media won’t speak on your behalf. We are seeing that in action.
