To: Attention Surplus Disorder

In “cross” Mannafort’s attorney will ask the witness who was in the courtroom while testimony was being given if he or she was in the courtroom and did they hear testimony being before they were called to testify. They will answer yes. Mannafort’s attorney will turn to the Judge and ask that any and all testimony given by the witness who was in the courtroom be stricken from court records and request the jury be instructed to disregard that testimony. Watch Mueller’s head explode!

I don’t know what to tell you. Obviously I was not there so I can’t say what did or did not happen. My brother, who is an attorney and judge, said there is no way a witness is allowed to sit in on prior testimony. It’s a thing that is simply not done. I cannot believe a high level court proceding would be playing games with this; it seems so banal and elementary. It would be like telling aircraft refueling guys that they can’t smoke on the job.
