claimed Ellis had actually granted permission earlier in the trial for the witness to remain in the room during proceedings.

Oh, BS. That would have been so irregular as to constitute grounds for the defense asking for a new trial right there. What was the prosecution even thinking? Why would they try to pull a fast one like that.

Well that’s an excellent question, but again we aren’t hearing that Ellis denied it either. Could this have been something a flustered Ellis actually did grant? But again, even a belated motion for a retrial would seem to make sense here.
