Loser pays is a bad solution - it just means that the government and the deep pockets can outspend the little guy until they win.

Not just "loser pays". In that case, they would just pick somebody with no assets to be the plaintiff.

If the suit is deemed frivolous, make the losing side's LAWYER pay.
