When the Louisiana State Militia finally arrived at the Colfax courthouse on April 15, 1873, all it could do was bury the bodies. Two days earlier, a large force of white supremacists had taken control of the courthouse from the mostly black faction protecting it. J. R. Beckwith, the U.S. attorney for New Orleans, told Congress that in the aftermath the ground was “strewn with dead negroes,” their bodies plundered by whites who had come to watch the bloodshed. The dead remained “unburied and mutilated,” Beckwith said, until federal troops arrived days later to shovel them into a mass grave.

The conservative majority on the Supreme Court today is similarly blinded by a commitment to liberty in theory that ignores the reality of how Americans’ lives are actually lived. Like the Supreme Court of that era, the conservatives on the Court today are opposed to discrimination in principle, and indifferent to it in practice. Chief Justice John Roberts’s June 2018 ruling to uphold President Donald Trump’s travel ban targeting a list of majority-Muslim countries, despite the voluminous evidence that it had been conceived in animus, showed that the muddled doctrines of the post-Reconstruction period retain a stubborn appeal.

I was pretty sure where this screed was headed just by the header and my suspicions where confirmed. Yup, by golly, if Kavannah is confirmed lynchings will be okee dokee. Yes there are evil POS miscreants out there on both sides. Seems like no one ever puts out a diatribe decrying the evil the SCOTUS may have upheld leaning to the lib side. Basically, anything conservative is bad, anything 'progressive' is awesome. NOT! Good luck Mr. Kavannagh. And, President Trump used his duly authorized powers to clamp down on immigration legally in case they aren't bright enough to figure that out. Libs that is.

Well then, with any luck Capital Punishment will be mandatorily instated in every state of the union and its protectorates. Tye electric chair can be lit up with wind and solar though, as a concession to the far out, anti law enforcement , whacko left.They can have the clean zap.

The Dems’ arguments assume that their policies would be supported neither by a Constitutionalist Supreme Court or an elected legislature. That is to say, their policies are both unconstitutional and unpopular.

Oh, you mean the 19th Century when the federal government was around 5% of the GDP and the average American was freer with a better quality of life than the average citizen anywhere in the world? The century where generally, the basis of Supreme Court decisions with a few notable exceptions, was the Constitution unlike the 20th and 21st Centuries where most Supreme Court decisions are blatantly unconstitutional?

You mean that century? Hope to God Kavanauh does take the Court back to Constitutional decisions like the 19th Century.
