Lawyer for couple accused of plundering GoFundMe for vet says 1 or both likely to be indicted

The Burlington County couple accused of misusing the $400,000 they raised via a Gofundme campaign to help homeless veteran Johnny Bobbitt may soon find themselves indicted and without legal representation, according to a motion from their own attorney.

Ernest E. Badway, the attorney for the couple, asked a judge Friday to stay Bobbitt's civil suit against his clients, Kate McClure, 28, and Mark D'Amico, 39, pending the outcome of a possible criminal case. Burlington County Superior Court Judge Paula Dow granted the stay Monday.

On Thursday -- two days after Bobbitt's attorney said he had learned that none of the $400,000 from the fund was left -- investigators executed a search warrant at the Florence Township home of McClure and D'Amico, seizing a black BMW and other items.

Great photo.

As soon as I saw the report last week that the police had seized the BMW, I knew these two knuckleheads were dealing with a serious criminal problem. The police don't get a warrant to seize property like that one week after a preliminary court hearing in a civil lawsuit without having strong evidence of criminality.

He didn't even get the 1999 Ranger. From a search - "Instead of the Ford Ranger, the couple gave him a used SUV, which reportedly broke down."

The husband (middle) looks like a hit man. He goes to jail. The woman looks like a nice person, but that probably means nothing. Her eyes are a little sneaky, though.

My theory is that they didn't start out to steal the money, thinking they wouldn't raise all that much. When the money started pouring in, they got greedy and thought they could keep it for themselves, and justify it by saying "he might spend it on drugs if we give it to him." That's a BS argument that nobody's buying. If he had the winning ticket in the state lottery, the state couldn't withhold his winnings from him because "he might misuse the money and spend it on drugs."

Not to me but he does look a lot smarter than his station in life suggests which tells me he is smart enough to pull himself up and out of the pit he’s in by his boot straps but with the drink and drugs he is not strong enough to give up; it keeps pulling him down.

Long term; he won’t do well most likely. I hope he proves me wrong though. I had a come to Jesus moment when I had to make the decision to keep drinking (beer) and risking (more) problems or to give it up and fly sober - so to speak. I chose wisely that time but honestly I wish I had made that same decision much earlier in life. Society makes drinking alcohol so accepted but it doesn’t spell out all the consequences of over imbibing well enough or loud enough IMHO and I was a social drinker. Never drank alone or to just get a buzz.

I agree. I bet they NEVER expected to raise that much money, and they lost all judgement and morality, as the amount ballooned.

Sounds like their lawyer is going to quit, now that he knows they have nothing left. “Badway”... LOL

Should be interesting to see how this all turns out. Sounds like the thieves no longer can afford an attorney so they will be stuck with a court appointed one.

Yeah; the guy does look shady for sure. I can never tell for sure with some women. Sometimes the girl next door looking ones are the worst of ‘em. They learn to use that to get away with all kinds of things. They know how to cry on command too.

If this was the Clinton Foundation, they would say they needed the BMW to visit him. The law enforcement officers would then be investigated by the FBI and IRS.
