Sessions neither comprises nor is coterminous with the DOJ. There are plenty of avenues for prosecution without direct involvement on the part of Sessions.
All federal prosecutions wind up in the hands of a US Attorney in a federal court. The USA’s are controlled out of DOJ and whoever in hell is running it.
