There absolutely needs to be a special counsel investigation of the FBI and DOJ. There’s ample evidence of corruption and lawlessness.

It will probably take several years..

Just fire 93 lawyers from the DOJ (like Clinton did)

Done in a weekend. The rest of the staff will be completely "unbiased" by Monday morning.

Trump CANNOT appoint a Special Counsel. Legally, only the AG can. If he is recused, it’s up to Rosenstein alone. Period.

Trump can order Rosenstein to do it, but he cannot do it himself.

Neither can Congress. They would have to pass a new law.

Those are the ONLY methods. All else is BS.

Yes, it is high time that Trump puts the commie RATS on the defensive in a BIG WAY. Throw out Mr. Magoo if needed and put a real AG in the DOJ. Time for RATS to get some respect back for the country and our laws and they need to go to jail.

Waaaayyy overdue.

They must be treating Graham like a mushroom or else he would be aware that someone else who is not part of the status quo is already doing that job.

You can’t have the DOJ investigate itself. Someone outside of the organization has to do that. It’s being done.

How are Sessions and Huber getting around that pesky 6th ammendment? You know, the one that says:

“In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law...”

Does Sessions have a secret waiver to the 6th ammendment?

Stupidity abounds around this fr thread. 90% due to Qooks believing things that are not, will not, can not happen. When you show them the actual laws governing the situation, or even the Constitution as written, they melt down.

Yes. Article 2 of the Constitution

I wasn’t aware that you could pass a law superseding the supreme law of the land.

Plenty of historical precedent for it, too. Grant, Roosevelt etc.

The first federal special prosecutor, John B. Henderson, was appointed by Ulysses Grant in 1875 to investigate the Whiskey Ring scandal. After attempting to stifle Henderson's investigation of the president's personal secretary, Grant fired Henderson on the basis that Henderson's statements to a grand jury regarding Grant were impertinent.[8] Following criticism, Grant appointed a new special prosecutor, James Broadhead, to continue the investigation.

James Garfield appointed the next special prosecutor, William Cook, in 1881 to investigate the Star route scandal. Cook continued his investigation into the Chester Arthur administration. Under the Theodore Roosevelt administration, special prosecutors were appointed to investigate two scandals. In 1903, Roosevelt appointed two special prosecutors (a Democrat and a Republican) to investigate allegations of bribery at the Post Office department. In 1905, Roosevelt's attorney general, Philander Knox,[9] appointed Francis Heney special prosecutor to investigate the Oregon land fraud scandal.

Calvin Coolidge appointed two special counsels, Atlee Pomerene and Owen Roberts to investigate the Teapot Dome scandal. This appointment was unique in that it was made under a special Congressional resolution, and was subject to approval in the Senate.[10]

In 1952, Harry Truman appointed Newbold Morris "special assistant to the Attorney General" to investigate the corruption at the Bureau of Internal Revenue following Congressional pressure and calls for a special prosecutor.[11] After Morris submitted a lengthy questionnaire on personal finances to be completed by all senior executive officers, he was fired by Attorney General Howard McGrath, who was in turn fired by the president. Following the appointment of a new attorney general, the investigation was continued through regular channels.

The law allowing for a Special Prosecuter is no longer in effe t. It’s been replaced by regs governing Special Counsel.

Did you finish reading the reference you losted? You know, the one that says:

“Since the expiration of the independent counsel statute in 1999, there has been no federal statutory law governing the appointment of a special prosecutor. Upon the law’s expiration in 1999, the Justice Department, under Attorney General Janet Reno, promulgated procedural regulations governing the appointment of special counsels.”

That is: 28 CFR Chapter VI - OFFICES OF INDEPENDENT COUNSEL, DEPARTMENT OF JUSTICE

Bottom line: Trump Cannot appoint a Special Prosecutor or Special Counsel under current law. You may not like that fact, but it is a fact. Calling in bs won’t change that fact.

It sucks, but that’s the situation Trump is stuck in, and there is no white knight in the shadows about to ride in. Sessions Screwed Trump Majorly, and there is no easy way out of it.

If you think Trump should do it anyway, heck, write him a letter. Go on TV. I somehow doubt he’s just going to write an EO establishing on anyway. But hey, I could be wrong.

That was for the congressional independent counsel statute. Nothing to do with the Executive. No law or DOJ reg overrides the President’s article 2 powers under the Constitution.

IOW, He can appoint a special counsel, special prosecutor or whatever the fargin hell else he wants and no one can do damn thing about it. Threaten to impeach i guess...

Article II says nothing about Special Counsel. You are making things up.

28CFR Is. The. Law. On. Special. Counsels.

Section 601: § 600.1 Grounds for appointing a Special Counsel.

The Attorney General, or in cases in which the Attorney General is recused, the Acting Attorney General, will appoint a Special Counsel when he or she determines that criminal investigation of a person or matter is warranted and - (etc)

Read it, learn it, know it, become informed. You will then sound like someone who knows what he’s talking about, because you will. You can point people to the actual law.

It’s more satisfying, and more fun. You then get to point out people who make stuff up, and talk out their A$$es.

You know, people like you.

And some crapped outside. But laws changed, and Presidents abide by current law, not past law.

You really need to find another subject to complain about. You’re not good at this one.
