Search warrant: Marijuana found in Botham Jean's apartment after deadly shooting

DALLAS - Following the shooting death of Botham Jean by the hands of Dallas Police Officer Amber Guyger, multiple search warrants were executed at Jean’s apartment as part of the investigation.

One of the warrants became a public record Thursday afternoon when it was returned to the judge who signed it. It was shortly after Jean’s funeral had ended. It listed several items found in Jean's apartment, including a small amount of marijuana.

Dallas police officer’s arrest affidavit contradicts search warrant for victim’s apartment

'An arrest affidavit for the off-duty Dallas police officer accused of killing Botham Jean contradicts a search warrant for his apartment. But police say evidence found at the scene confirms that Jean was across the room when he was shot.

Amber Guyger, 30, is charged with manslaughter in the fatal shooting of Jean, 26, on Sept. 6. She told police she mistook Jean’s apartment for her own and opened fire because she believed Jean was an intruder.

An arrest affidavit released Monday says Guyger’s apartment is directly below Jean’s at the South Side Flats, 1210 South Lamar.

The affidavit, written by Officer David L. Armstong of the Texas Rangers, is based on what Guyger told the officer happened. It says she “inserted a unique door key, with an electronic chip, into the door key hole. The door, which was slightly ajar prior to Guyger’s arrival, fully opened under the force of the key insertion.”

It then says that the door being opened alerted Jean to Guyger’s presence. It says Guyger described the apartment as being dark and she thought “she had encountered a burglar, which was described as a large silhouette, across the room in her apartment.”

Guyger drew her firearm, “gave verbal commands that were ignored by (Jean),” and then she fired two shots. Jean was shot once and died.

However, a search warrant written on Sept. 7 and signed by Judge Brandon Birmingham tells a different story. An officer within the police department told the Dallas Morning News that the search warrant was written before Guyger was interviewed.

“An off-duty Dallas Police Officer, who was wearing a full Dallas Police uniform, was attempting to enter apartment number 1478, with a set of keys,” it says. “An unknown male, inside the apartment, confronted the officer at the door. A neighbor stated he heard an exchange of words, immediately followed by at least two gunshots.”

While the arrest warrant describes Jean as being “across the room,” the search warrant says he confronted Guyger at his door.'

OK so she purportedly entered this man’s apartment by mistake thinking it was hers, in the dark, and shot him to death, firing twice into the dark.

And, looking at the inventory of that apartment after she shot him to death, we see:

- 1 black backpack with police equipment and paperwork
- 1 black ballistic vest with “police” markings

So she blew him away in the dark, then removed her ballistic vest with police markings as well as a backpack filled with police paperwork and equipment.

She was, however, off duty, regardless of any attempts at muddying the water as to whether she’d just gotten off of a 12 hour shift or a 15 hour shift.

Did she impersonate an officer while off duty for some reason? Was she sloshed after drinking in a bar while in uniform? Did she sit down with her murder victim and smoke a bowl with him prior to murdering him, while in uniform?

None of it sounds good for this woman.

Here where I live it is legal to grow it (with a permit), harvest it, and process it.
What most people don’t know is that it is still illegal to TRANSPORT IT.
95% of the roads get some form of FEDERAL FUNDING, it’s still a FEDERAL VIOLATION.
No; I don’t grow it, I prefer apples, pears, peaches, cherries, etc.

An attempt to ruin his reputation.

They should at least be consistent and leak the items found in the cop’s apartment obtained in the warrant. Wait - did they even get a warrant to search the cop’s apartment yet?

I can’t believe the comments coming from FR. There is more to this story, and it will come out. An obvious tragedy. The attitudes here might as well have come from BLM. Did you all forget the 5 Dallas Police Officers killed by a BLM person while they were protesting? This woman deserves her day in court, so wait until then. She just came off a 15 hour shift in Dallas, so for someone to think she planned to kill someone after 15 hours of work is despicable.
