I just read on Guy Benson's Townhall column the most compelling argument possible to put an end to this charade:

If these charges against Kavanaugh are so damning as to derail his SCOTUS nomination, then he should be immediately removed from the DC Court of Appeals too, right?

If Kavanaugh is a rapist that makes him unfit for the Supreme Court, shouldn't he be unfit for the court he sits on now?

We should demand that everyone who is questioning Kavanaugh's confirmation publicly state their support for removing Kavanaugh from the DC Circuit Court. If they refuse to do so, they are admitting that the charge against Kavanaugh is not credible.

How can we have one character standard for the Supreme Court, and allow lesser character for the lower courts? It's okay to attempt rape if you're a lower court judge, but that disqualifies you from the Supreme Court?

Who is going to go on record to take the destruction of Kavanaugh to the next step based on this one questionable accusation? Their silence on that question should tell everyone all we need to know about what they think.

Actually, the premise is false that if the allegations derail his SC nomination then he should be removed from the COA. That is because the standard for confirmation is the consent of the US Senate based upon the individual judgment and conscience of each Senator. The standard is a political choice. The standard for removal is at least clear and convincing evidence if not beyond a reasonable shadow of a doubt.

Now as the to liability of Dr. Ford, accusing someone of rape is per se slander and per se malice. She bears the burden to prove her claim with clear and convincing evidence. This is probably why she is ducking the opportunity to appear and testify under oath.

They would certainly respond by saying he’s not fit for that court either. It costs them nothing to do so.

I really don’t think the democrats CARE what we think. If they were given that option, they’d GLADLY take it. Getting Kavanaugh off the Appeals court AND the SC would be a great big twofer for them. It’s not as if they have any shame, or anything. They are NOT going to play fair, honorable, and honest. It’s manifestly IMPOSSIBLE for them to do so, and they wouldn’t do, even if they could.

There was no rape. Nor any accusation of rape.

This is finding its own life in the narrative, and it’s a shame.

There was “groping” there was no rape.
