She sent the letter to Eshoo rather than Feinstein because had she sent it directly to FEINSTEIN, that would be legally actionable should it turn out to be a lie. Not so by sending it to Eshoo.

BUT if she goes before the Judiciary Committee with a false claim, under oath, that would make it actionable.
