He'll miss one week, no big deal.
No, if he doesnt start with the rest of them, he has to sit it out until the next session. The Dems want to try to impeach Trump in October. What a stupid thug for him to do.
He won’t be part of cases heard while he wasn’t seated, it doesn’t keep him from any participation in the session...
The longer this circus drags on, while it is horrible for the Judge, is all the better for the GOP in the midterms so LONG AS THEY CONFIRM HIM!
“He’ll miss one week, no big deal.”
Looking at the Supreme Court Calendar (see https://www.supremecourt.gov/oral_arguments/2018TermCourtCalendar.pdf ) he will end up missing the first 3 days of oral arguments and thus will be unable to participate and vote on those cases. There are only 40 days set aside for oral arguments, thus 3/40, or about 7-1/2 percent of the argued cases will lack a potentially essential conservative vote. If there is any way for the Court to delay until he is seated, they should try. There are 6 cases on the docket for these three days - haven’t taken a look to see what they are but any one of them could be critical (see https://www.supremecourt.gov/oral_arguments/argument_calendars/MonthlyArgumentCalOctober2018.pdf )
‘He’ll miss one week, no big deal.’
no doubt that’s true; however, the optics of folding to the radical Dems absurd requests seems feckless as hell...
This will go one a long time Im afraid, the “goalposts” will be moved further back many times and the dems know that they have a few trump cards in Flake, Collins and Murkowski.
Damned shame it has come to this, sitting senators that have no regard for the rule of law or facts, but are swayed by emotional basket cases that are lying out of both sides of their faces.
What makes you think Flake, Collins and Murkowski will agree to confirm him in a week? After this stunt, I highly doubt they will.
What day would he start?
Nielsen v. Preap (Oct. 10 2018 "Whether a criminal alien becomes exempt from mandatory detention under 8 U.S.C. § 1226(c) if, after the alien is released from criminal custody, the Department of Homeland Security does not take him into immigration custody immediately.")
I'm not sure if SCOTUS can re-open an issue (see above) after a 4-4 vote.
