A lawsuit filed by a Democratic senator from Oregon aiming to compel the Trump administration to release 100,000 pages of documents on Supreme Court nominee Brett Kavanaugh is inching forward in federal court, with an Obama nominee assigned to hear it.
Sen. Jeff Merkley’s lawsuit, filed Wednesday in federal court in the nation’s capital, has been overshadowed by sexual harassment accusations against the nominee, but the case remains alive, with summonses prepared for U.S. Attorney General Jeff Sessions and others, court documents show.
Now Merkley is asking the federal court to order the Trump administration, which has claimed executive privilege in withholding the 100,000 documents on Kavanaugh, to delay hearings until they’re produced and senators can digest them.
Merkley told reporters in a conference call Wednesday that “we’re seeking the court to intervene and give senators access to the nominee’s record.”
The judge assigned to the case, Amy Berman Jackson, was nominated to the federal court by then-President Barack Obama in 2011. She has handled some high-profile cases.
Jackson was to have presided over the trial of former Trump campaign manager Paul Manafort until he pleaded guilty in a plea bargain earlier this month. Jackson said Manafort’s plea deal requires him to cooperate “fully and truthfully” with the special counsel’s investigation of Russian interference in the 2016 presidential election.
At the center of Merkley’s lawsuit are records from when Kavanaugh worked in the George W. Bush White House as legal counsel and then as staff secretary. The Trump administration says disclosing records from his tenure as legal counsel would disrupt the functions or decision-making processes of the executive branch.
But that’s not all. Amy Berman Jackson was also the judge who tossed out a lawsuit against Hillary filed by the families of Benghazi victims Tyrone Woods and Sean Smith.

The Constitution is in the TOILET. No Federal judge has ANY jurisdiction over the internal affairs of the Senate. Anyone who’s read the Document knows that. The fact that these Demonrats are pressing this shows that the Republic is history.
It appears to me that when a judge decides he is now the
Executive Branch of the government and issues a ruling, shouldn’t the DOJ intercede and rule it unconstitutional and let it wind its way to the Supreme Court?

This is what I posted about a few days ago. Senator Leahy is behind this. This is their PLan B to delay but also if he does get confirmed, they will try and impeach him.
It is based on draft letter by Leahy to Democrats on their strategy for interviewing judicial nominees. A Republican aid named Miranda had access to a shared server by both parties. He discovered a draft letter by Leahy, He emailed a copy of this draft to folks in bush admin, including Kavanagh. He was asked about that email this month by Leahy. That email is in the 100,000 docs Trump is with-holding.
At issue, Leahy had asked Kav if he knew it was stolen at that time, he said I did not. Leahy said, the heading said spying, wasn;t that a clue. He said no, we have many staffers on both sides of parties who often talk and share information.
Anyways, Leahy is gunning for the docs in attempt to prove he knew they were stolen. Miranda has defended Kav and said he didn’t know where I got the doc from I never told him.
All fine and dandy until we have the same 3 or 4 RINO’s saying, we need to see those docs before we vote to confirm.
An unelected judge cannot direct an elected Congress not to vote. That is a Constitutional violation, crisis & casus beli.
